Application For License to Employ Non-Resident Employee Under Section 119, Labour Ordinance (Sarawak Cap. 76)                            <\/span>\n\n                        <\/div>\n                        <div class=\"bdt-ep-accordion-content bdt-accordion-content\">\n                            <p style=\"text-align: justify;\"><strong>Requirements to Obtain a License to Employ Non-Resident Employees.<\/strong><\/p><p style=\"text-align: justify;\">Employers who intend to employ non-resident workers in Sarawak are required to obtain a Non-Resident Employee Employment Licence as provided under Section 119 of the Sarawak Labour Ordinance (Chapter 76).<\/p><p>\u00a0<\/p><p style=\"text-align: justify;\"><strong>Penalty<\/strong><\/p><p style=\"text-align: justify;\">An employer who fails to obtain the said licence may, upon conviction under Section 130L of the Sarawak Labour Ordinance (Chapter 76), be liable to a fine not exceeding RM50,000.00, or imprisonment for a term not exceeding one year, or both.<\/p><p>\u00a0<\/p><p style=\"text-align: justify;\"><strong>Application for a Non-Resident Employee Employment Licence.<\/strong><\/p><p>Employers are required to apply for and obtain a Non-Resident Employee Employment Licence from the Director of Labour, Sarawak. The categories of non-resident employees covered under Section 2 of the Labour Ordinance (Sarawak Chapter 76) are manual workers regardless of wage level, and non-manual workers earning up to RM2,500.00.<\/p><p>Employers must first register job vacancies and advertise the positions through <a href=\"https:\/\/www.job.sarawak.gov.my\" target=\"_blank\" rel=\"noopener\">www.job.sarawak.gov.my<\/a><br \/>before submitting the application, except for Renewal Licence Applications for the following positions:<\/p><p>\u00a0<\/p><ol><li>General Worker in Agriculture Sector; and<\/li><li>Skill-Worker in Reflexology<\/li><\/ol><p style=\"text-align: justify;\"><em>(Renewal applications for both of these positions may be submitted directly online through the Sarawakian &amp; Non-Sarawakian Online Labour System.)<\/em><\/p><p>\u00a0<\/p><p style=\"text-align: justify;\">Employers must also ensure that the salary offered to the non-resident worker being applied for is commensurate with the position and not lower than the prevailing minimum wage rate. In addition, the proposed worker must possess qualifications or experience that are not less than the criteria stated in the job vacancy advertisement. Furthermore, employers are required to comply with all applicable labour laws currently in force.<\/p><p style=\"text-align: justify;\">All applications must be submitted online through the <em>Advanced Labour and Immigration Aligned for Compliance (ALIANCE)<\/em> at <a href=\"https:\/\/www.aliance.sarawak.gov.my\" target=\"_blank\" rel=\"noopener\">www.aliance.sarawak.gov.my<\/a><br \/>, under the <em>Gateway and Employment for Non-Sarawakian sub-module via the Sarawak\u2019s Integrated System Employment of Non-Sarawakians (Genesis).<\/em><\/p>                        <\/div>\n
