Labour Case

Labour Ordinance (Sarawak, Cap.76) empowers the Director to resolve any disputes between employees and employers in respect of payment of salaries and other cash payments through a Tribunal known as the Labour Court.

 

Authorized officers will hear and decide on the disputes between the employees and the employers.

Procedure to File Labour Case

Be present personally and give an oath statement before an Officer to record down the claim and submit important documents / information: –

 

  1. Name and address of the complainant.
  2. Identification card or passport / travel document for foreign workers.
  3. Employer’s name and address.
  4. Letter of appointment and a contract of service.
  5. Income and payroll details.
  6. The type and amount of the claim.
  7. In the case of a joint claim, a joint claim authorization letter must be completed and signed by all claimants; and
  8. Letter of termination (if applicable).
Parties Who Can Make Labour Case Claims

(a)  Salaries or any other payment under the contract of service, any provision under the Ordinance / Rules.

(b)    Confirm or quash (set aside) any decision under S.14 (1). The case shall be filed within 60 days from the date of the decision.

(a)    Salary or any other payment under a contract of service.

Section 8C

Labour Ordinance (Sarawak Cap 76)

Employees whose wages exceed RM2500 but not exceeding RM5000.
(a)  Salary in lieu of notice is given when the service contract is terminated without notice, or if notice is given without waiting for the notice period to end.
